Ideally, a website owner should ensure that the website design and the content of the website are assigned to it or licensed to it for the necessary purposes. Failure to do so could mean that the website owner is infringing copyright, trade marks, design rights or registered designs.
All website owners should be vigilant to ensure that, by featuring photographs, video clips, images, logos, trade marks and text on their website, they are not infringing third party rights. Those websites which allow users to post their own contributions are subject to the greatest risk, since they will be unable to control (at least initially) whether third parties’ copyrighted material or trade marks are actually posted on the site.
In very general terms, copyright in drawings, designs and other images will usually belong to the person who has created them or to his/her employer. Rights in film or video clips can belong to a number of different people (depending upon when and where the video or film is made) including the producer and principal director (or their employers), the author of the sound recording and performers. Trade marks will either belong to the person who has registered them at the relevant trade marks registry or (if they are unregistered marks) by the person who has designed them, or his/her employer or licensee.
It will be important, therefore, when using any material on a website which the website owner knows has not been created by him to establish whether he is entitled to do so. Usually, it will be necessary for the website owner to have a licence from the copyright/trade mark owner for such use or (preferably) an assignment of such rights. For example, a photographer might have allowed a company to reproduce his photograph in a company brochure; such permission will not necessarily extend to use of that photograph on the company’s website.

QUESTION:
How do I find out who owns a domain name?
I want to buy a certain domain name to put up a website. The domain name isn’t used, but it unavailable. How do i find out who owns it?-
ANSWER:
To find the owner of any domain, the first step is to go to a whois site.1) http://www.whois.net
2) Input the domain in the ‘WHOIS Lookup’ section
3) You will generally see the owner of the domain under ‘Registrant’,'Administrative Contact’, or ‘Technical Contact’.*Sometimes domain owners have hidden their names by purchasing extra privacy options. In a case like this, they generally will have a made up name and company, BUT you will see a masked email address. This masked email address will not be the owners actual email address, but will forward to the owner.
If you need additional help or questions please feel free to contact me as I own a domain company and work with similar matters often.

QUESTION:

QUESTION:
Who Actually Owns Domain Name Registration.?
Who Actually Owns Domain Name Registration, i mean when we buy a domain name who do we pay for the privilege. I know hosting company’s offer domain name registration and take a cut if they are a reseller, but who owns the actual business.-
ANSWER:
I’m not sure that it is a business. I think if you have a domain name server you can register domains. It is more of a standard than a business. I found this: http://en.wikipedia.org/wiki/Internet_Corporation_for_Assigned_Names_and_NumbersThat organisation oversees domain names but isn’t a business but a non-profit organisation.

QUESTION:
Who owns a domain name if a designer stops working on the website?
We asked a designer to build our website, and he acquired domain names for it. He was since relieved of his duties, but the domains are registered in his name. We’ve since launched the business and he is refusing to turn over the domains to us. What are our options, aside from the costly WIPO/NAF procedures? Can we sue in small claims? We are in Wisconsin.-
ANSWER:
I would sue in small claims court.Yes, technically, he is the registered owner. But he registered the names while under contractual obligation with you to turn over all works and derivative works related to the task he was hired to perform, so he was legally obligated to turn over the domain name registrations to you at that time.
Otherwise, it would be no different than a developer claiming he owns all the code he wrote for you because it was on his machine.
Contact a lawyer and have them pursue it for you. You’ll win.

Their standard price is /year (.95) but they have
a 50% sale, one year of hosting for .00.Their plan includes:
Unlimited disk space

QUESTION:
Who owns a domain name registered by a UK company that has now been dissolved and how can I get hold of it?
Hello. I want to register a domain name but the one I want is already registered to a company that has subsequently been dissolved (I checked with Companies House). Presumably the legal entity no longer exists so can I get hold of the domain name myself? Does anyone have any advice on how to proceed?-
ANSWER:
If someone already owns it, you could buy it from the owner. You can get a hold of the owner through Whois lookup. If you can’t get a hold of the owner (or if they’re not selling), you could always choose a different top-level domain. See http://buywebspacetoday.com/how-to-buy-a-web-domain/ for a more detailed information.

QUESTION:
I am wondering about buying a domain name? Who really am I “buying” it from? Who “owns” it? (see details)
I have already done the domain name thing through Yahoo once, and so far I am satisfied. However, I am want to understand, am I just renting the name? Or what? I want to own my domain name, so I want to make sure I am not just renting it (you know, before my website really “takes off,” haha). Also, now this depends on how the above question is answered, but I may be looker to get a domain name somewhere cheaper, or without the apparent “middle-man.” I’ve read some other Yahoo Answers about these topics and I’ve found some good resources (people mention godaddy and some other sites) but I don’t understand what is with the middle man and who are they selling these domain names for? And can’t I go around them?
I understand my “question” is kind of all over the place, but any intelligent repsonses will be much appreciated. Thank you everyone in advance!!
-
ANSWER:
There is an organization called ICANN that regulates all domain names. In order to have one be set aside for your usage, a registrar has to do all the leg-work. These are the “middle-men” that you are referring to. If you think about it, ICANN “owns” all the domains ever, and is “leasing” them to whoever pays the registration. As long as that fee is paid (and renewed before it expires) you will have control over the domain name.

QUESTION:
Who owns rights to a domain name prior to me registering it in my name?
If I goto yahoo small business services to register a domain name that is listed as being avalible, who owns the rights that are transfered to me upon registration?-
ANSWER:
Answer: A domain name is a name associated with a particular computer online. In the domain name www.chillingeffects.org, .org is the top-level domain (“TLD”), chillingeffects is the second-level domain name, and www is a subdomain. Domain names are looked up on name servers in the DNS hierarchy to resolve them to numerical IP addresses.A domain name registration, like a telephone directory listing, is simply a service by which the domain registry agrees to list your domain name and the corresponding IP address in its domain zone file (such as the .com zone file). The routers that forward data bits around the Internet must consult these zone files to know which machine you’re using. If the registry removes the domain name from the zone file, then routers (and users) will not be able to address mail or see your website if they use your domain name. They can, however, still reach you by using your IP address.
There are over 250 top level domains (like .com, .us and .uk). Each has its own procedures for handling registrations and trademark disputes.
Nobody owns the rights, a DNS server resolves the name. You can purchase specific domain names that goes with IP addresses. Those IP addresses are owned by an organization. I believe it is called the ISO. Internet Standards Organization.

QUESTION:
Who owns the rights to my web site and domain name?
If I wanted to sit up a website and used a third party to do so i.e. a developer, who would own the domain name and rights to the web site. Would I own it as I am the one commissioning the site or would the developer own it as they would be the ones developing and registering a domain name for me. As far as I am aware there is not much law covering this subject in Ireland. If anyone has any ideas I would appreciate any feedback.
Ok I want to expand the question somewhat.
SO say I pay a developer to design a web site, register a domain name, host my site, and carry out maintence on the site on my behalf, obiviously paying them a fee for this. But if i find that I could pay another developer less for what I am currently paying for both hosting and maintenece is it not my right to change over. I want to know does the devoloper have a say in the matter, unless there was a contracted involved. I have had experiecne where I have payed a devopler to host my site and then found a cheaper soultion only to have the devoloper kick up a fuss and then charging me for a copy of my own site on disc. Is there a law that covers this or I am on my own. How can I be charged for something that is my own intellectual property as i am the one footing the bill. Any feedback again appreciated.-
ANSWER:
This matter is entirely between you and the developer, but if the website is yours then you should own the domain — you may, however, want to nominate the developer as the technical contact if he is going to be maintaining the site.

QUESTION:
Who owns my domain name?
I have a site through Yahoo. The domain was available and I started a website with Yahoo using that domain name. Did Yahoo register that site in my name? Or does it belong to Yahoo and they are letting me use it? Can I end my service with Yahoo and start my site up elsewhere and still use the same domain name?-
ANSWER:
No, we don’t own domain names. Never have, never will.Domain names are the results of licensing agreements between us and the domain provider we use. They will create a record or entry in the computer databases used to register and manage domain names, we assign a unique name to it that no one else can use, and we are licensed to use it for a period of time.
Don’t believe me? Then read your domain provider’s registration agreement and see if it EVER says you own it.
You can register your domain name and sign up for your website with a separate hosting company (which is really a good arrangement for security and safety reasons, despite the potential inconvenience). You can also cancel your services and transfer your domain registration to another provider, but read the fine print and ask questions before doing so.

QUESTION:
When you buy a domain name, who gets the money?
If you buy a domain from a registrar then you have to pay. Obviously the registrar gets some money. But doesn’t some of it go to a third party? If so, then who is the third party? If not, then why can’t I register my own domain names instead of needing a registrar?-
ANSWER:
ICANN is the international organization which is responsible for all internet addresses. They charge a fee for every domain registration, then the registrar itself has to pay setup and licensing fees to be a registrar with ICANN. This is not cheap. In fact you have to have ,000 cash on hand to become a registrar according to ICANN policy. There is no way to buy domain names direct from ICANN, but there are plenty of good registrars out there. Unlike Network solutions and others that charge + per year for a single domain, you can get a domain + e-mail hosting for .99 from Speed-Register.com. I’ve used them a lot, it is really easy.

QUESTION:
Who actually OWNS domain names?
Who actually owns domain names? If you “register” the domain name, do you then own the name? Is there only one entity with whom you have to register the name (i.e. is there an official governmental (or any other authorizing body)?)I want to register a domain name (I’ll have to pay someone else to host it) but once I get the name, I want to own the name, not rent it from someone to whom I give the name idea. How do I do this? Thanks for your help!
-
ANSWER:
ICANN. In certain respects, it’s similar to the U.S. Patent Office, which is charged with protecting your idea, creative work or trademark. I’ve never heard of them stealing anything they’re charged with protecting, but I suppose it’s possible.Likewise, ICANN is charged with registering and thus protecting your name from duplication, so as long as they’re the recognized authority, your name is safe with them.
It’s a fairly involved organizational structure, so you’ll probably have to study it, but your answer lies with them.

QUESTION:
Who owns website if partner pays for domain name?
I have a web design client who has been operating with a partner in another country for many years. My client owns the name of their business but her partner created the website and gets the bill for the domain name and is the first point of contact for her clients. She would like me to redesign the website and change the it so that she is the first point of contact on the website but she is very worried that her partner actually owns the website and could shut down the site at any point effectively shutting down her business. They have a healthy relationship but it is suspicious that her partner is the first point of contact and may not be forwarding her all the business that the site is getting.I have not handled many web sites yet and I am unsure what to tell her about this. Does anyone know if she legally owns the website even if she doesn’t pay for the domain name. Note that she does own the name of the business. Any help or advice would be much appreciated. Thanks
Thanks for your answer Nik, the partner overseas handles tours and my client handles setting up the tours and contacting her clients. She got involved with her partner a long time ago and I think he knew more about web design than she did so he took on the responsibility of the domain name etc but she has thought that she owned it all this time.
Having a database for their clients is a good idea. She is just worried that he technically owns the site and could take her business away.

QUESTION:
Who owns a .com domain name before you buy it? Also, why do you have to buy it?
I just don’t understand, where exactly the money goes? Can’t you just register it somehow yourself rather than having say, godaddy register it?
So who owns the DNS Machines i guess is what im getting at. And if its say.. godaddy, then why cant I just have my own little DNS machine?-
ANSWER:
nobody owns it. What your paying for is DNS propagation. When you are typing in a web address your computer checks a dns server to see where that url points to (an ip / port of a computer somewhere). What you are actually paying for is the service on all the dns machines to have them say mywebsite.com = 192.168.1.1:22 … that’s alllike i said, your paying them so they will say your website = your website’s location.

QUESTION:
how do i find who owns a domain address?
I registered a domain name a few years back and have not used it, now I do but how on earth do I access it to publish material….I have lost the documents with company from which I bought the domain name?-
ANSWER:
Depending on the type of domain, you usually register for 12 months (or sometimes 24 months) at a time. It is probable that your registration of the domain has expired – if you are really unlucky someone else may have it now…
The best lookup for domains that I know of is the domains tools site:http://www.http://whois.domaintools.com/
That will tell you what company holds the registration (if any) and who (if any) is the technical contact. If you still have it in your name, the registration company you registered it with will be in the report along with your contact details as the technical or admin contact.
If you are still the registered owner, you will need to log into the registration service control panel to use the domain.
If you need to register it again, I would recommend registering with Godaddy or 1&1 internet, I wrote an article about the services I use – see the URL below…

QUESTION:
How can I get a domain name that’s already taken?
I’d like to have a web page using a particular name. It appears to exist currently but only with a holding page; hosted by Yahoo. Is it possible to find out if the space is dormant or active, or who owns the domain name? Can it be bought?
Grateful for helpful replies
-
ANSWER:
You actually have a couple of options here. The first option is to find the owner of the domain name and offer to buy it from him.You can find the owner of the domain name by doing what is called a “Who Is” search on the domain name. The “WhoIs” is basically like the phone book for web address’s. This will display the owners contact information. This will include his name, his phone number, his e-mail address, and his physical address. You can use any of those means to contact the owner. You can complete that search here:
http://whois.domaintools.com/
Now I will warn you, it can sometimes get pricey to buy a domain name from a buyer. The reason is because they know you want it, and there are probably others who want it too. If you are not willing to spend too much money on purchasing it from the buyer (which will probably costs you a couple of hundred) you do have another option.
What you can do is place a “back order” on a domain name. In the event that the domain name expires, and is not renewed by the owner, you will get a notification and the chance to buy it, at a normal price (between -40 depending on who you use). In the case that multiple people back order the same domain name, it will go into an auction and the highest bidder will take home the prize! You can easily find a company of your preference by searching Google.
http://www.google.com/search?sourceid=chrome&ie=UTF-8&q=back+order+domain+name#hl=en&sa=X&ei=us6KTeTyLO2C0QHOxtzwDQ&ved=0CBsQBSgA&q=backorder+domain+name&spell=1&bav=on.2,or.r_gc.r_pw.&fp=c770469246f6e773
I know others have answered this, but I just wanted to give you a full explanation of the options so you know whats available to you.

who basically owns then sells out domain names? why can’t you make up your own domain name for free? and finally can someone point me in the right direction to make a website on your computer but only for your computer (offline)? thanks-
ANSWER:
All domains are managed by a non-profit organization called ICANN. In order to become a domain registrar, a company would need to be approved by ICANN and they would have to pay various fees for both the application process and the upkeep of being a domain registrar. In order to create a website on your computer, it’s quite simple. Create a new file on notepad, name it as index.html. From there, start coding and put all related files in the same folder as index.html. You can view your website using your browser.

QUESTION:
Domain name/hosting geek squad please?
When you look up a domain name on Whois, if a domain called mydomain.com is registered through GoDaddy.com, with the Registrant listed as the owners name, who owns the domain? If the Whois server is Whois.GoDaddy.com, and the domain servers in listed order are: NS.RACKSPACE.COM and NS2.RACKSPACE.COM, what does all of that mean?
Is the domain name (mydomain.com) registered to the person/company that created it, or is it a subdomain on somebody else’s web domain? How can you tell when researching the name on Whois?
What is the difference between the company that a website is registered through (GoDaddy.com) and the domain servers?
-
ANSWER:
they used godaddy to register it, the owner owns the namesometimes you may not know who owns the site, some people may pay extra and have their info hidden, like godaddy’s service domains by proxy
domain servers are who is hosting it, they do not register the domain in most cases, they just are providing the hosting

QUESTION:
Who owns the internet?
You know how you have to pay go daddy 12 bucks a year to own a website. Well why is that just hosting fees? So people can access the site? Like who originally owned all the domain names and then decieded to charge people? And what happens if the person hosting the site losing their connection to the internet? Can I just buy that domain name? Who deciedes all this stuff? Bill Gates would be my guess.-
ANSWER:
No-one owns the internet, that’s part of the point. Its a load of networks linked together with a common protocol. The money you are paying to GoDaddy is the fee for lease of the domain name.Every location on the internet requires a process where the name, for example YourDomain.com, get translated to a number, 64.14.143.57 in this case. The servers that are required to perform this aren’t free to run. After you have this number it will then find a route to the location the website or service is stored/run from. Again the servers that perform this aren’t free to run.
The “internet” is a industry like most others so a lot of the decisions are take at a industry level, with all the players agreeing to a common set of goals and standards.

QUESTION:
If I cancel the provider of my domain (Who set up my web site) name will I lose my domain name?
Im about to start my own website using homestead www.homestead.com they will charge me per month and include free with that my own domain name. My question is…… When I want to start my own web site and not use homestead no more and cancel them ie dont pay the will I still be able to retrieve my domain name of them if they set it up and I cancel-
ANSWER:
According to the Terms of Service from Homestead [1]:“1.3.2 You will be listed as the registrant and administrative contact in connection with your domain name”
Since you are listed as the registrant, you should be able to transfer the domain name to a new domain name registrar without much trouble. Find a new place (I use omnis.com [2], but anywhere where you can register domain names for under 10 bucks a year should be fine) and contact them about it. They should be happy to assist you in transferring your domain name to their service, especially if you offer to register it through them for 2-3 years.
By having your domain name registration separate from your hosting, it gives you the ability to change hosting providers at will. You will likely just need to add a CNAME or A record to your DNS and it will redirect all traffic to the new host within 24 hours or so. Your hosting provider will be able to give you information on what you need to set and your domain name provider should provide instructions on how to set it.

QUESTION:
Why can’t i own my Domain name for life?
Why can’t someone buy a domain name for life? Who owns all the domains?
Why can’t i pay just a onetime fee for it like i only pay one big fee for my car and own it for life like i own my car for life with out any payments?-
ANSWER:
Business and other, nobody goes out and buys a bunch of space to add to the internet unless they do it as an investment, charity, or a gov agency to keep the system from crashing…Something about how the internet and stored information is provided and accessed, that’s why there is talk of a new internet, with a different setup, I think everything must be stored on a drive somewhere… they are trying to change that or something? The system is getting backed up and slowed down because of all of the stuff it has to organize or something, I’m technologically illiterate… but it’s the vague idea. System overload.

QUESTION:
Why must I pay Yahoo .95 a month for a domain when I also have to pay Melbourne IT who owns the domain?
I thought I would reactivate my web page which used to be on earthlink, but signed up with Yahoo this time. They offered .99 for the first month, then .95 a month thereafter. I found that I had to get the name redelegated – but not from Earthlink. A company named Melbourne IT manages all domain names and I must pay them also, it seems. I am so confused. Plus — he .95 a month only covers a one-page website unless I upgrade to a higher rate! I don’t know how to proceeed without getting ripped off.-
ANSWER:
contact yahoo directly you should not have to pay twice

QUESTION:
Techies, Geeks, Puzzlers, Researchers, Lawyers: Who owns Vertical Axis, a dominant domain buyer?
This company is an enigma, and I am certain one of the brains on the net can help break the mystery of who owns them.A bit of history: They have been in various internet news articles for successfully buying the domain names of products and companies and winning the right to own them, in court. And, apparently a lot of individuals have found their domains sold to that group or person when domain registrars have sometimes sold domains at auction.
The question is, who are they?
And, can they own these domains?O.k., I admit I am not a researcher or internet savvy enough to know how to do anything more than superficial searches, but, in all of my searches, I have not been able to find out a single individual’s name associated with their company other than their lawyer’s, some geeks I have talked to have speculated that perhaps they are a registrar buying up the good and valuable names for resale. And, I have found them as having at least 2 countries other than the US as their address locations. -The only number I could find was in one of those countries, but my calls would never go through. SO I called the US wmbassy for the country it was based in and they said that they did not recognize something about the number leading them to think maybe it was a cell phone.
So, a bunch of unanswered questions, fo me, making the mystery all the more complex. Please help me solve it.
And, by the way, I don’t just have idle curiosity, they bought one of my domains that my registrar at first rold me was available for me to transfer to another registrar, which was my plan, but it never came available, and then, after the sale was done, it came to light how -auction, without my having had the chance they had pretty clearly seemed to indicate that I would.
I actually want to try to buy my domain back from these people or this person, but they haven’t answered any emails and my calls for some reason won’t go through on the overseas number they have listed.

QUESTION:
What to do if I buy a domain name off somebody?
Hi,I just agreed to buy a domain name from an individual who owns the rights. What do I do to insure I have all the rights to it? Do I just take his screenname and password from his registrar?
-
ANSWER:
Once you own the domain name, you own the rights to it. What domain name registrar does that individual use? Sign up for an account with that registrar, which would be free.Ask the domain seller to do an account transfer to transfer your domain to your account.
P.S. Taking his screenname and password does not make the domain name yours. Unless you configure the Address and relevnt info to your own, in that account. But the above way is how it is done.
